Hire Terms

The hirer’s acceptance and/or payment of any hired or purchased goods implies the acceptance of these conditions of hire. All hire goods are subject to GST.

1. General

The ‘company’ refers to Envy Events who provides the goods for hire. ‘Hirer’ refers to any person or company who hires or agrees to hire goods from the company. ‘Goods’ meaning any hired or purchased items.

2. Deposit/Bond

A deposit of 20% of the total invoice may be required upon confirmation of booking. Once payment has been received, the goods will be secured for the date of booking. A bond of 20% will be charged with the final invoice and held until all items have been returned. The bond will be credited via bank transfer within 5 working days after the return of all goods. The company has the right to hold a bond and deduct replacement expenses if goods are missing, broken or damaged.

3. Payment Terms

All invoices are to be paid in full prior to collection of goods. The company reserves the right to hold off collection of goods until full payment has cleared. If goods are missing, broken or damaged, the company will inform the hirer of the replacement costs and deduct those costs from the bond. The remainder of the bond, if any, will be credited via bank transfer within 5 working days after the return of all goods. If the replacement costs exceed the bond, the company will issue an invoice to the hirer of the total cost of replacements, less the paid bond. The hirer agrees to pay this invoice within 7 days. Overdue accounts are subject to a 2% monthly finance charge. Debt recovery costs will be at the hirer’s expense.

4. Hire Period & Due Care

All goods are subject to a 5 day hire period unless otherwise stipulated on the invoice. Collection & return of goods are by appointment only. The hirer will ensure the safety of all goods whilst in their care. Goods must be returned in the condition they were collected in, including the return of all packaging materials/boxes. Failure to do so may incur charges.

5. Delivery & Collection

The client can opt to add delivery and collection to their order; charges vary depending on location and times. Upon collection, all goods must be packaged and boxed and left in an assessable area. All vessels that have been used for food, beverages or flowers must be rinsed before being packed.

6. Retention of Title

The goods remain the property of the company for the duration they are in the hirers care and the hirer agrees not to sell, sublet or lend the goods to a third party.

7. Limitation of Liability

The hirer acknowledges that the company will in no event be liable for any losses or damages that arise in connection with this contract. No insurance is offered on the goods while in the hirers care. The hirer is responsible for any damages or losses the goods, use of the goods or lack of use of the goods may cause. The hirer shall not have any claim against the company for any injury, loss or damage to the hirer, a third party or property as a result of the use of goods provided by the company. The hirer indemnifies the company against any claim made by a third party for any injury, loss or damage as a result of the use of goods provided by the company.

8. Cancellations & Changes

The company reserves the right to cancel the order at any time for any reason. The hirer must submit any cancellations in writing to the company, cancellations by the hirer are subject to the following terms; cancellations made less than 30 days from the date of collection will be subject to 50% cost of the total order, cancellations made less than 7 days from the date of collection will be subject to the full cost of order, no refunds of deposits will be made for cancellations outside these periods. The company reserves the right to supply similar goods to those booked if for any reason those goods are unavailable.

9. Refunds/Replacements

The company agrees to check all goods on date of collection for breakages and damages. In the event the goods are missing or broken through no fault of the hirer, the company agrees to issue a refund for the goods in question under the following conditions; the hirer informs the company of the missing item/breakage as soon as possible, the hirer gives the company sufficient time to supply a replacement, the broken or damaged goods are returned in their original packaging. No refunds will be issued for missing or broken goods if these conditions are not met.
